The terms and conditions governing your use of Fling.
These Terms of Service ("Terms") govern your access to and use of Fling ("the Service"), operated by Insure AMS ("we," "us," or "our") at flng.ai. By creating an account or using the Service, you agree to these Terms.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Fling is a software-as-a-service platform that enables users to upload AI-generated HTML forms and surveys, configure data delivery (including HubSpot CRM sync, CSV download, and email delivery), and publish them as live, hosted web applications with integrated bot protection and submission management.
You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access to your account at hello@flng.ai.
The Service is offered on a subscription basis. By selecting a paid plan, you agree to pay the applicable monthly or annual fees. Subscription fees are billed in advance. Form Publish Credits are billed at the per-credit rate applicable to your plan, charged at time of publish or invoiced in arrears for credits used beyond your monthly allowance.
All fees are non-refundable except as required by applicable law or as expressly stated in these Terms. We reserve the right to change pricing with 30 days' written notice.
We may offer a free trial period. During a free trial, you have access to the features specified for that trial. At the end of the trial period, your account will automatically convert to the plan associated with the trial unless you cancel before the trial ends. No credit card is required to start a free trial.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to:
We reserve the right to suspend or terminate accounts that violate these provisions without refund.
You retain ownership of all HTML files, form content, and submission data you upload to or collect through the Service. You grant Insure AMS a limited license to store, process, and transmit that content solely to provide the Service as configured by you.
You are solely responsible for the content of your forms and surveys, including ensuring you have the right to collect the data you are collecting, that respondents are properly informed about data collection, and that you comply with all applicable laws.
If you connect a HubSpot account to the Service, you authorize us to access and write to your HubSpot CRM data using the scopes you approve during the OAuth authorization flow. You are responsible for ensuring your use of the HubSpot integration complies with HubSpot's own terms of service.
The Service, including its software, design, user interface, and documentation, is owned by Insure AMS and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without prior written consent.
We aim to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned maintenance where possible.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SALESPOWER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Insure AMS and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
You may cancel your account at any time from your account settings. We may suspend or terminate your account for violation of these Terms, non-payment, or any other reason with or without notice. Upon termination, your access to the Service ends immediately. You should export your submission data before cancelling as we delete account data within 90 days of termination.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on flng.ai at least 14 days before changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Florida.
